Wishify is a mobile application that allows users to create and manage wishlists, with optional AI-powered description generation features.
3. User Responsibilities
3.1. You are solely responsible for any content you create, transmit, or display while using the App.
3.2. You agree not to use the App for any unlawful purpose or in any way that violates these Terms.

4.1. The App and its original content, features, and functionality are owned by the developer of Wishify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4.2. You may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of the App's content in whole or in part except as expressly authorized by us.

7. Disclaimers

7.2. We do not warrant that the App will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OF WISHIFY BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APP.
9. Modifications to the App and Terms
9.1. We reserve the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice.
9.2. We may revise these Terms from time to time. The most current version will always be posted on the App. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms.
9.3. We may release updates to the App to improve functionality, fix bugs, or comply with new regulations. These updates may introduce changes to existing features or add new features that may be subject to additional or modified terms. By installing updates or continuing to use the App after an update, you agree to be bound by any revised or additional terms that may apply to new or modified features.
10. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If such negotiations fail, both parties agree to submit to the exclusive jurisdiction of the courts in Austria.
13. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms constitute the entire agreement between you and the developer of Wishify regarding the use of the App, superseding any prior agreements between you and the developer relating to your use of the App.
16. Acknowledgment
By using the App, you acknowledge that you have read these Terms of Service, understood them, and agree to be bound by them. If you do not agree to these Terms of Service, you must not use the App.
