End-User License Agreement (EULA) for Wishify
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and the developer of Wishify ("Licensor", "we", "us") for the software application Wishify, including all associated media, printed materials, and electronic documentation (collectively, the "Application").
By installing, copying, or otherwise using the Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Application.
1. Grant of License
Subject to the terms of this EULA, Licensor hereby grants you a limited, non-exclusive, non-transferable license to install and use the Application on a single mobile device owned or controlled by you, solely for your personal, non-commercial use.
2. Restrictions
You may not:
- a) Modify, reverse engineer, decompile, or disassemble the Application;
- b) Rent, lease, lend, sell, redistribute, or sublicense the Application;
- c) Copy, distribute, or create derivative works based on the Application;
- d) Remove any proprietary notices or labels on the Application;
- e) Use the Application for any unlawful purpose or in violation of any applicable laws.
3. Ownership
The Application is licensed, not sold. Licensor retains all rights, title, and interest in and to the Application, including all intellectual property rights.
4. Third-Party Services
The Application may integrate with third-party services, specifically the Groq API. Your use of such services is subject to their respective terms and conditions, which you are responsible for reviewing and complying with.
5. Privacy
Your use of the Application is subject to our Privacy Policy, which is incorporated by reference into this EULA.
6. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and destroy all copies.
7. Disclaimer of Warranty
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE APPLICATION IS WITH YOU.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APPLICATION.
9. Export Regulations
You agree to comply with all applicable export and re-export restrictions and regulations.
10. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
11. Entire Agreement
This EULA constitutes the entire agreement between you and Licensor regarding the Application and supersedes all prior negotiations, agreements, and understandings concerning its subject matter.
12. Updates and Additional Terms
Licensor may release updates to the Application to improve functionality, fix bugs, or comply with new regulations. These updates may introduce changes to existing features or add new features that may be subject to additional or modified terms. By installing updates or continuing to use the Application after an update, you agree to be bound by any revised or additional terms that may apply to new or modified features. Licensor will make reasonable efforts to notify you of significant changes through in-app notifications or other appropriate means.
